Thousands (at least) of specialty occupation RFEs have been issued by USCIS over the past months. USCIS has been issuing these RFEs for a wide variety of employers so few are immunite. Essentially, USCIS is challenging whether an H-1B position requires a bachelor’s degree or higher in a specific field related to the position (which is the minimum standard for H-1B).

This is not a new issue but has been used widely in the recent months by USCIS to scrutinize H-1B petitions. We have been very active in researching and analyzing legal and factual ways to respond to this kind of RFEs and we feel that we have come up with ways to craft a case that a position not only requires a bachelor’s degree but also that such degree is in a specific field related to the position.
