Cap-subject H-1B Filing Window Open

The filing window for Fiscal Year 2010 (starting October 1, 2009) cap-subject H-1B petitions opened today.  All of the cap-subject H-1B filings filed by our firm were successfully delivered at their respective USCIS service centers.  Our first impression was that FedEx’s service was very reliable and all H-1B filings were delivered early in the morning and much earlier than FedEx had committed.

As a reminder, the FY 2010 H-1B filing window will remain open until April 7th, when USCIS will evaluate whether the H-1B cap has been reached.  If the cap is reached as of close of business on April 7, 2009, USCIS will cease accepting H-1B petitions and conduct a lottery.  If the cap has not been reached as of close of business on April 7, 2009, USCIS will continue accepting H-1B petitions on April 8 and until the cap is reached.
