USCIS Increases I-907 Premium Processing Filing Fee Starting October 19, 2020

The Department of Homeland Security has substantially increased the I-907 premium processing service filing fee from $1,440 to $2,500 starting October 19, 2020.   Under the optional premium processing service USCIS is required to provide a response within 15 calendar days to most (but not all) employment-based I-129 and I-140 petitions.

Rationale of Fee Increase

The USCIS announcement relies on the Continuing Appropriations Act, 2021 and Other Extensions Act, Pub. L. No. 116-159, signed into law on October 1 which allows USCIS to raise the premium processing fee in order to continue funding its operations. P.L. 116-159 also allows USCIS to expand the premium processing service to other types of cases but this expansion not yet been implemented.

Conclusion

We hope that the fee increase would allow USCIS to be able to increase staffing levels and to increase the level of service, especially in light of recent trends of extremely high request for evidence (“RFE”) rates for certain types of cases, most notably H-1B petitions.
