USCIS Removes Biometrics Requirement (and Fee) for All I-539 Applications

Starting October 1, 2023 USCIS is removing the biometrics requirement (and fee) for all I-539 applications seeking to change of extend status.    As a reminder, the biometrics requirement and fee were created in 2019 and in 2021 USCIS removed this requirement for H-4, L-2 and certain E applicants.   Now USCIS is removing the biometrics requirement and fee for all applications to extend or change status filed using Form I-539 starting October 1, 2023.

Applications Filed After October 1, 2023 Should Not Include Biometrics Fee

Beginning October 1, 2023, USCIS will exempt the $85 biometric services fee as part of the application process for Form I-539.   This fee must not be included if the application is postmarked October 1, 2023 or later.

In most cases, after October  1, 2023,  applicants will not be scheduled to attend a biometric services appointment. However, if USCIS determines that biometrics are required, the applicant will receive a notice with information about appearing for their biometric services appointment (see what to expect during a biometrics appointment).

Conclusion

We applaud USCIS’s announcement and its efforts to make the application process smoother and faster.   Our office will continue to monitor developments relating to this policy change including details and nuances of its implementation.
